Terms of Service
In these Terms and Conditions of Sale, "Claudia&Julia", "we" and "us" mean "We Love Cooking, S.L." and "You" shall mean you, the customer.
These general conditions of sale (hereinafter the "conditions of sale") govern the legal relationship arising from the purchase and sale processes carried out by You on the website located at the url and its owner, We Love Cooking, S.L., with CIF B66594979, registered office at Josep Comas i Solà 22a, 08243 Manresa (Barcelona), and registered in the Companies Registry of Barcelona, volume 44961, page 52, sheet 472592, entry 1. You accept the conditions of sale from the moment you use or contract the service or purchase any product. This document may be printed and stored by You. Claudia&Julia provides you with the email address tienda@claudiaandjulia.com, so that you can raise any questions regarding the conditions of sale.
Claudia&Julia reserves the right to modify the content and/or scope of the General Conditions of Purchase at any time, without the need to notify or warn in advance, therefore please read their content carefully as it is the Customer’s responsibility to review the General Conditions of Purchase before purchasing any product from the Website/App.
1. Placing your order
1.1. When placing a purchase order through the Website/App, the Customer declares that they are over 16 years of age and have the legal capacity to contract the products on the Website.
1.2. You may place the order through our online store at www.claudiaandjulia.com, by writing to tienda@claudiaandjulia.com or by calling 935 953 729. Orders submitted in any way other than those indicated above will not be accepted.
1.3. Once your order is accepted, we will send you a confirmation by email which will also include the order number. The order confirmation will be effective from the time it is sent. If we are unable to process your order due to any incident, we will contact You by email or telephone.
1.4. To place an order at Claudia&Julia, you need internet access to connect to www.claudiaandjulia.com and add the product or products you wish to purchase to the cart.
1.5. Once all required products are in the cart, proceed to checkout to reach the Shipping Methods and Payment Methods selection screen.
1.6. Once the order has been placed, Claudia&Julia will send customers an email with the order receipt containing the purchase summary, as well as payment information if applicable and shipping and billing details.
2. Supply of your order
2.1. We will supply you with the products indicated in your order confirmation, in accordance with these terms and conditions of sale.
2.3. Orders are received twenty-four (24) hours a day, three hundred and sixty-five (365) days a year; however, orders placed after fourteen (14) hours will not be processed and will be carried over to the next business day in the city of Manresa. Orders received over the weekend will be processed first thing on the following Monday or next business day.
3. Prices
3.1. The price of the products includes the corresponding VAT and will be the one indicated in your order and/or invoice.
3.2. The VAT at the applicable rate indicated on your invoice shall be borne by you. "Intra-Community acquisitions cannot be made through our online store".
3.3. Shipping costs, where applicable, are at your expense, as will be indicated in your order and invoice.
3.4. The free shipping promotion for purchases over thirty-five (35) euros (VAT included), a promotion that is active occasionally and not permanently, excludes shipments to the regions of the Balearic Islands, the Canary Islands, Ceuta and Melilla (when it is active).
3.5. Claudia&Julia discounts and promotions will only be valid during the indicated dates or until the promotional units run out. Under no circumstances will products be sold at a price of 0 that are not subject to a promotion.
3.6. Claudia&Julia makes all reasonable efforts to ensure that the information shown on its website is truthful and free of typographical errors. If an error of this type occurs in product prices, with amounts that are manifestly incorrect and outside usual market prices, Claudia&Julia, as a corrective measure, reserves the right to cancel orders and refund the amounts received for them.
3.7. Gift wrapping is individual wrapping for each product. We reserve the right to cancel this service in cases where we cannot guarantee an optimal result, such as pieces that are too large, or sets made up of more than one piece.
4. Payment for your order
4.1. You may pay for your products using any of the payment methods enabled on our website:
• Card or Bizum payment The Customer must enter their debit/credit card number (Visa, Visa Electron and Mastercard), as well as the other additional information required during the purchase process. The charge will be made once it is accepted by the Customer’s financial entity; otherwise, the purchase cannot be completed.
The customer is solely responsible for the accuracy of their payment method information, therefore Claudia&Julia is not responsible for any loss the customer may suffer as a result of incorrect payment method information provided.
• Cash on delivery The customer must pay the exact amount to the carrier. This payment method is limited to 999,99€ and is only available for deliveries in Spain or Portugal. This service costs 2,5€.
• Payment by bank transfer to the account number indicated on the Website/App owned by We Love Cooking, SLU, the corporate legal name of Claudia&Julia, and the Customer must indicate the order number. Bank fees applicable to the transfer will be borne by the Customer.
• Payment via PayPal: the Customer must have a PayPal account to use this means of payment.
4.2. You must pay in the currency indicated on your invoice. We only accept payments in Euros.
4.3. If you pay by credit card, you must provide your credit card details at the time of placing your order. We only accept payments with secure cards in which your identity as the cardholder is authenticated according to the method established by your bank, through the secure electronic commerce service ("Verified by Visa" and "MasterCard SecureCode").
4.4. If you pay by bank transfer/deposit, the necessary details to make the payment will be sent to you by email. Your order will not be reserved or shipped until we have received payment into our bank account. If we do not receive payment in full within four (4) business days from the date of your order, it will be cancelled.
5. Delivery of your order
5.1. We will send your order to the shipping address stated on your order request.
5.2. We will ship your order within the shipping time indicated on our website on the date your order confirmation is issued. You may cancel your order at any time before it is shipped by sending an email to tienda@claudiaandjulia.com indicating your order number.
5.3. At the time your order is handed over to our carrier, we will send a shipping confirmation to the email address you provided when placing the order. In the shipping confirmation we will indicate the tracking number corresponding to your shipment so that you can track it through our carrier’s website, according to the shipping method you selected.
5.4. Deliveries are made within 1 or 2 business days in mainland Spain. Some areas far from urban centers or provincial capitals do not have daily delivery, so delivery will be made on the first available day by the transport agency, and the 1–2 business day estimate may be delayed. The customer can track their order from the website of the agency that delivers your order.
5.5. Title and risk of loss of the products in the order will pass to you upon delivery of the order.
6. Returns and right of withdrawal
6.1. If you are not satisfied with any of the products in your order, you may exercise the right of withdrawal and request a return within the first 14 calendar days.

7. Warranty
7.1. The warranty for products sold at Claudia&Julia will be in accordance with current legislation and, therefore, as a general rule, they have a legal warranty of three (3) years from delivery for orders placed from January 1, 2022.
7.2. Notwithstanding the foregoing, products shall be deemed compliant and, consequently, excluded from any warranty when:
a) The damage or deterioration to the products sold by Claudia&Julia is due to causes beyond the manufacturer or Claudia&Julia or, where applicable, those acting under their responsibility (force majeure, accident, etc.) or as a consequence of incorrect use, configuration, or installation of the product by the Customer.
b) The damage or deterioration to the products sold is caused by or originates from a component not supplied by the manufacturer or Claudia&Julia, or is the result of alterations or repairs carried out by persons outside the manufacturer or Claudia&Julia or, where applicable, those acting under their responsibility.
7.3. Shipping costs for processing the warranty are covered within mainland and island Spain and mainland Portugal. Outside these territories, You must bear the shipping costs both outbound and return.

9. Content and information supplied
9.1. Claudia&Julia reserves the right to modify the commercial offer regarding promotions on the website www.claudiaandjulia.com (promotions in effect at the time of the user’s purchase will be respected) at any time.
9.2. Claudia&Julia makes all reasonable efforts to ensure that the information shown on its website is truthful and free from typographical errors. If such an error occurs, entirely beyond Claudia&Julia’s control at all times, it will be corrected immediately as soon as it is detected. If the error occurs in any of the prices shown and a customer has made a purchase, we will inform you of this error and proceed to cancel the order.
9.3. Claudia&Julia obtains the features and descriptions of the products offered on the website from the information provided by manufacturers and distributors to Claudia&Julia and, in some cases, from their own websites. If the product information does not correspond to the actual features, the customer may cancel the order at no cost.
9.4. The information presented on this website is in Spanish (Castilian language), including the formation of the contract and all contractual information displayed and sent to consumers or users.
9.5. Some products may be opened from their original boxes to check for possible defects, or protected if necessary to secure the product during transit. Under no circumstances are these products used.
10. Data protection
We Love Cooking S.L. is the Controller of the personal data you provide to us and informs you that this data will be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April, Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights, and Law 34/2002 of 11 July on information society services and electronic commerce.

11. Force majeure
We will do everything possible to fulfill the obligations arising from your order. However, we will not be liable for delays or non-performance if the delay or non-performance is due to force majeure. In case of delay, we will fulfill our obligations as soon as reasonably possible.
12. Online dispute resolution
In accordance with Art. 14 of the Regulation 524/2013 of the European Parliament and of the Council of 21 May 2013, on online dispute resolution in consumer matters, Claudia&Julia informs Customers that they may submit their complaints to the dispute resolution platform available at the following link: http://ec.europa.eu/consumers/odr
13. Applicable law and jurisdiction
The General Conditions of Purchase shall be governed by and interpreted in accordance with Spanish law.
In the event of any conflict or discrepancy in the interpretation or application of the General Conditions, the competent Courts shall be those provided for by the applicable regulations on the competent jurisdiction for consumers and users.
14. Nullity and invalidity of clauses
If any clause included in these conditions of sale is declared, in whole or in part, null or invalid, such nullity or invalidity shall affect only that provision or the part thereof that is null or invalid, and the remaining conditions of sale shall remain in force, with such provision, or the affected part thereof, deemed not to have been included.
